South Korea's three foundational ICT laws—Broadcasting Law (2000), Telecommunications Business Act (1991), and Radio Waves Law (1961)—are architecturally misaligned with the digital and AI era, as they remain anchored to outdated transmission mediums and infrastructure-based classifications. The market has already converged around internet-based services where broadcast, telecom, and wireless are indistinguishable to users, yet the regulatory framework perpetuates fragmented silos, creating blind spots in cloud integration, platform governance, and spectrum innovation. Comprehensive legislative reform—not incremental patches—is critical to establish coherent, function-based regulations that enable rather than constrain digital ecosystem growth and national competitiveness.
